At Tasty Court, we are dedicated to providing excellent food and service. However, by dining with us, using our services, or purchasing our products, you agree to the following Limit of Liability:
1. General Liability
Tasty Court is not responsible for any damages, losses, or injuries incurred while dining at our establishment, using our takeaway or delivery services, or consuming our food. This includes but is not limited to:
Personal injury, allergic reactions, or illness.
Damage to property or belongings.
Losses due to theft or misplacement of personal items.
2. Food Allergies and Dietary Restrictions
While we take care in preparing our food, Tasty Court cannot guarantee that our dishes are completely free from allergens (such as nuts, gluten, dairy, etc.) or cross-contamination. It is the customer’s responsibility to inform us of any specific allergies or dietary restrictions prior to ordering.
Tasty Court will not be held liable for allergic reactions, health issues, or injuries related to dietary preferences or restrictions that are not communicated to our staff.
3. Takeaway and Delivery Orders
Tasty Court is not liable for any damages or losses that occur once the food leaves our premises, including during transit by third-party delivery services.
Once food is accepted by the customer or a third-party courier, Tasty Court is no longer responsible for its handling, and we will not be held liable for temperature changes, contamination, or spoilage caused after the food leaves our control.
4. Third-Party Services
For delivery orders placed through third-party platforms (e.g., UberEats, DoorDash), Tasty Court does not assume responsibility for delays, delivery issues, or damages that occur while the food is in the possession of the third-party courier. Any claims must be made directly with the delivery platform.
Tasty Court is not liable for errors made by third-party platforms or any disputes that arise through their service.
5. Limitation of Financial Responsibility
In no event shall Tasty Court be held liable for any incidental, indirect, or consequential damages, including but not limited to:
Loss of profits.
Loss of opportunity or enjoyment.
Emotional distress or reputational harm.
The total liability of Tasty Court, whether in contract, tort, or otherwise, shall not exceed the amount paid by the customer for the food or service that gave rise to the claim.
6. Force Majeure
Tasty Court will not be held liable for any failure to perform its obligations due to circumstances beyond our control, such as natural disasters, acts of God, pandemics, government regulations, or any other events outside the reasonable control of the restaurant.
7. Governing Law
This Limit of Liability shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
